TERMS AND CONDITIONS

Please read these Terms and Conditions carefully before making a booking.
By paying your deposit, you (and all members of your party) acknowledge that you have read, understood, and agree to be bound by the Terms and Conditions set out below.

It is in the nature of sailing voyages, that we aim to visit remote and hard-to-access locations, this however does come with some inherent risks. The gathering of information about your health & fitness is to ensure that guests have a full understanding of what a sailing voyage entails and that we, Eda Frandsen Sailing Ltd, have all the information we need in case of an emergency.  

Eda Frandsen is a traditional sailing vessel and typical restrictions in terms of space apply. The bunks on board are small single beds, arranged as bunk beds. All guests must be able to climb in and out of top bunk berths, we cannot always guarantee priority over certain bunks. A good level of mobility is required to move around the boat whilst at sea and at anchor.

There is a 2 metre ladder into the saloon of the boat, which is unavoidable. Guests also need to be able to climb from the side of Eda Frandsen into the dinghy and out of the dinghy onto a beach landing. 

1. Booking and Payment

1.1 Booking Confirmation

  • Once Eda Frandsen Sailing Ltd (referred to herein as “we,” “us,” or “the Company”) receives your enquiry, we will check availability and contact you to confirm your voyage.

  • Your booking is not secured until we have confirmed availability and received a 25% deposit of the total voyage fee.

  • Please do not book any travel arrangements until you have received confirmation of your voyage from us.

  • The lower age limit for unaccompanied guests is 18 years.

  • Children aged 12 to 17 are welcome if accompanied by a parent or guardian.

  • If the whole boat is booked, younger children may be permitted at the Skipper’s discretion.

  • Any persons who will be over the age of 75 years at the time of travel should highlight this in the booking form and confirm with the Skipper their overall level of fitness for the desired voyage. 

1.2 Balance of Payment

  • The remaining 75% of the voyage fee is due 8 weeks before the start date of the voyage.

  • If your booking is made less than 8 weeks prior to the start date, full payment will be required at the time of booking.

  • If the balance payment is not made within 7 working days / by the date stated on the invoice without prior arrangement. Eda Frandsen Sailing reserves the right to re-sell the voyage immediately. 

2. Cancellation by You

2.1 Cancellation Notice
If you wish to cancel your booking, you must notify us at the earliest opportunity.

2.2 Refunds and Fees

  • If you cancel your booking within 14 days of paying your deposit and there are at least 8 weeks remaining before the start of your voyage, we will issue a full refund minus an administration fee of £50.00 per party member.

  • Your deposit becomes non-refundable 14 days after the date of booking.

  • If you cancel 8 weeks or more before the start of the voyage, you will be liable for 50% of the full voyage fee.

  • If you cancel less than 8 weeks before the start of the voyage, or after the voyage has commenced, you will be liable for 100% of the voyage fee (no refund).

  • Resale of Your Berth: If we are able to resell your cancelled berth, we will reimburse you the full cost less the deposit. The berth will be advertised at the first possible opportunity following your cancellation, in order to avoid liability for the cost of the cancelled berth, the voyage must be resold at its original price. You may not be notified of whether this has been achieved until after the start date of the booked voyage. 

2.3 Travel Insurance
You are strongly advised to take out appropriate travel insurance that includes cancellation cover, as well as cover for any personal circumstances preventing you from traveling. Please see section 16 for more details on insurance. 

3. Amendment to Voyages

3.1 Right to Amend

  • Eda Frandsen Sailing Ltd reserves the right to amend any voyage details, including start/end destinations or planned itineraries, if necessary.

  • In the unlikely event of changes, we will endeavour to inform you as soon as possible.

3.2 No Liability

  • All decisions regarding amendments are made by the Skipper in consideration of safety, weather conditions, crew experience, and other relevant factors.

  • No refunds or liability are accepted by Eda Frandsen Sailing Ltd for any changes.

  • We are not responsible for any cost of travel arising from any changes.

3.3 Amending Your Booking

  • If you need to change your voyage details or substitute crew members, please contact us at the earliest opportunity. All such changes are subject to availability and at our discretion.

  • An amendment fee of £50 will apply to any approved change.

  • A change of voyage cannot be made less than 8 weeks before the departure date; such a request will be treated as a cancellation and the applicable cancellation terms will apply.


4. Cancellation by Us

4.1 Force Majeure
In the event that we must cancel a voyage due to unusual and unforeseen circumstances beyond our control (such as war, riot, civil strike, industrial dispute, terrorism, natural disaster, pandemic, or other force majeure events), we will endeavour to offer you an alternative voyage on a mutually agreeable date. No further liability is accepted.

4.2 Other Reasons for Cancellation

  • If we have to cancel a voyage for reasons such as mechanical failure or any other circumstance within our control, we will offer you either a full refund of all monies paid or an alternative voyage.

  • In all cases, our liability is limited to the amount paid; we will have no further liability to you for consequential or economic loss.

5. Health and Safety

5.1 Primary Concern

  • Your safety is our main priority.

  • Eda Frandsen is equipped with safety gear in excess of that required by law and is run by an experienced and qualified crew.

  • A full safety briefing will be provided at the start of the voyage. You will be provided with a Health, Safety and Fitness questionnaire following the safety briefing to confirm receipt and understanding of the information. You will also be asked to confirm current health, fitness and medical information on the day of departure. 

5.2 Obligation to Follow Instructions

  • You must agree to abide by all instructions given by the Skipper and permanent crew at all times.

  • Participation in handling sails, taking the helm, and other tasks is part of the experience. A reasonable level of fitness is required.

5.3 Disclosure of Medical Conditions

  • If you or any member of your party has any medical condition, including. without prejudice to the generality of the foregoing, angina, asthma, diabetes, epilepsy, giddy spells or a heart condition, which might incapacitate them, or might be pregnant, or have recently been discharged from hospital, or have limited mobility this must be disclosed in the Booking Form.

  • This information will be kept confidential.

  • Failure to disclose any relevant condition may result in the affected individual being put ashore for their own safety, with no refund or reimbursement of expenses.

  • If anyone is being treated with prescribed drugs for any of the above or for any ailment or for any other reason, this must be stated in the booking form, stating, in plain language, the condition and drugs used. You should also check with your doctor for alternative medication in case seasickness renders regular medication ineffective. You must ensure that you are carrying the correct drugs and dosage for the voyage, and that you should ask your doctor for the appropriate brand of anti-seasickness remedy to take.

  • The Skipper is not able to dispense or administer any medication including nonprescription drugs (for example anti-seasickness, paracetamol, or ibuprofen), except in first aid situations.

  •  Guests are advised to bring a small personal first aid kit and seasickness provision.

  • Anyone wearing spectacles or contact lenses are advised to bring a spare pair for the voyage.

5.4 Skipper’s Decision is Final

  • We aim to sail Eda Frandsen as much as possible, considering weather, crew ability, and navigational conditions.

  • We will endeavour to meet reasonable requests, but the Skipper’s decision on all navigational and safety matters is final.


5.5 Ship and Port Security

  • To comply with the International Ship and Port Facility Code, guests must not bring on board any inflammable or dangerous goods, prohibited substances, or pets.



6. Respect for Other Crew and Guests

6.1 Conduct Onboard

  • You are expected to treat all fellow crew members, guests, and crew with courtesy and respect.

  • Offensive, abusive, or disruptive behavior will not be tolerated.

6.2 Consequences of Misconduct

  • The Skipper reserves the right to terminate the voyage for anyone whose conduct endangers the safety, comfort, or enjoyment of others.

  • In such cases, no refund will be given, and you will be responsible for any additional costs incurred.

7. Alcohol and Drugs

7.1 Alcohol Consumption

  • The consumption of alcohol onboard is at the discretion of the Skipper.

  • You are welcome to bring a reasonable amount of your own alcohol; there will be a small selection onboard. 

  • Excessive alcohol consumption jeopardizes safety and can be grounds for being put ashore or refusal of further service, without refund.

7.2 Illegal Drugs and Prohibited Substances

  • Illegal drugs or prohibited substances are strictly forbidden onboard.

  • Any passenger found in possession of illegal substances will be reported to the relevant authorities and may be disembarked at the nearest safe port, without refund or further liability to the Company.

8. Pets

8.1 General Policy

  • Pets are not permitted on board.

9. Bookings Non-Transferable

9.1 Non-Transferable Clause

  • Bookings are personal to the named individual(s) and are not transferable to another party without our prior written consent.

  • Any attempt to transfer a booking without our consent will be deemed a cancellation, and the applicable cancellation fees will apply.

  • Bookings are specific to the dates booked. Bookings cannot be transferred to future voyages. Rebooking a voyage at a later date will be treated as a cancellation and cancellation fees will apply. 

10. Visas and Passports

10.1 Passenger Responsibility

  • It is your responsibility to ensure that you (and all members of your party) have all necessary visas, valid passports, or other documentation required to embark on your voyage.

  • Guests on a passage voyage must carry a passport OR identification allowing them to travel between Ireland, the Isle of Man and the UK.

  • Failure to obtain the correct travel documents may result in denial of boarding, with no right to refund.

10.2 No Liability for Documentation Issues

  • We accept no liability if you are prevented from sailing due to insufficient or invalid travel documents.

11. Complaints

11.1 Procedure

  • If you have any complaint about any aspect of your voyage, please raise it with the Skipper or a member of the crew at the earliest opportunity so that we can attempt to rectify the issue promptly.

11.2 Formal Complaints

  • If your complaint is not resolved to your satisfaction during the voyage, you should submit your complaint to us in writing as soon as possible (and no later than 14 days after disembarkation).

  • We will make every effort to investigate and respond to your complaint promptly and fairly.

12. Accuracy of Information

12.1 Voyage Descriptions

  • We strive to ensure that all information regarding itineraries, vessel specifications, onboard facilities, and voyage details is accurate and up to date.

12.2 Changes Beyond Our Control

  • Occasionally, errors may occur, or conditions may change. We reserve the right to correct any errors in published materials and to update information as needed.

  • We will notify you of material changes where possible; however, we accept no liability for minor inaccuracies or discrepancies in published information.

13. Consequential Losses

13.1 Exclusion of Indirect Damages

  • Except as otherwise required by law, we will not be liable for any consequential, incidental, or indirect damages (including lost profits, lost enjoyment, or costs of alternative arrangements) arising out of or in connection with your voyage.

14. What Is Included

  • A berth and bedding for each person.

  • All food and soft drinks while onboard.

  • Use of the vessel’s oilskins.

  • Wellington Boots

  • Towels

  • All necessary safety equipment, lifejackets, and harnesses.

  • Mooring and fuel costs during the voyage.

15. What Isn’t Included

  • Meals taken ashore.

  • Any tours ashore (e.g., distillery visits).

  • Alcohol

  • Travel to and from the vessel’s start and end ports.

  • Personal travel insurance.

16. Insurance

16.1 Company Insurance

  • Eda Frandsen is covered by professional insurance that includes third-party liability.

  • This does not cover you for loss or damage to your personal property unless caused by our negligence or defects in the vessel.

16.2 Personal Insurance

  • We strongly recommend you obtain your own comprehensive travel insurance covering, at a minimum:

    • Medical expenses and personal accidents.

    • Loss and damage to personal effects.

    • Cancellation or curtailment of your voyage.

    • Sailing beyond 12 nautical miles offshore.

17. Variation of Terms

  • Eda Frandsen Sailing Ltd reserves the right to update or amend these Terms and Conditions.

  • We will make every effort to inform anyone who has already booked if a significant change is made to these Terms and Conditions.

18. Entire Agreement

  • These Terms and Conditions, together with your Booking Confirmation, constitute the entire agreement between you and Eda Frandsen Sailing Ltd.

  • They supersede and extinguish all previous agreements, promises, assurances, warranties, representations, and understandings between the parties, whether written or oral, relating to their subject matter.

20. Law and Jurisdiction

  • This contract is governed by Scottish law, and any disputes arising out of or in connection with the contract shall be subject to the exclusive jurisdiction of the Scottish courts.

21. Authorization to Execute

  • By booking a voyage and remitting payment (deposit or otherwise), you represent and warrant that you are authorized to enter into this agreement on behalf of yourself and any other members of your party.

  • You further confirm that the necessary consents and approvals have been obtained and that this Agreement is legally binding upon you.

Final Acknowledgment

Receipt of your deposit confirms that you and each member of your party has read, understood, and agreed to these Terms and Conditions. If you have any questions or concerns, please contact us before completing your booking.
